Terms of Service

2.1. Subject to compliance with these Terms, Company grants Customer a limited, non-exclusive, non-transferable right to access and use the Service for internal business purposes.

2.2. The Service allows Customer to create, configure, and manage chatbots ("Bots") that interact with end-users ("End Users") via third-party messaging platforms (e.g., Telegram, VK, WhatsApp).

2.3. Customer is responsible for all activity occurring under their Account and for keeping credentials secure.

3.1. Customer agrees NOT to use the Service to:

• Send spam or unsolicited messages in violation of applicable laws or messenger rules.
• Promote illegal activities, scams, phishing, or malware.
• Distribute content that is violent, hateful, or infringes on third-party rights.
• Attempt to reverse engineer, hack, or disrupt the Service.

3.2. Violation of this section may result in immediate account termination without refund.

4.1. Services are provided on a paid basis according to the tariffs published on the website and available in the user dashboard. Prices are in Russian Rubles (RUB); VAT is not applicable (Simplified Taxation System).

4.2. Payment is made online via connected payment gateways (Tinkoff or equivalent). The billing cycle and feature scope depend on the selected plan.

4.3. Refunds are provided only if the Service was technically unavailable due to Company's fault, or if requested within 24 hours of payment without usage. Requests must be sent to info@glav-bot.ru.

5.1. The Company may offer certain features or the entire Service on a free trial basis ("Trial Service"). The Company reserves the right to modify, cancel, or limit the Trial Service at any time without liability.

5.2. Some features may be designated as "Beta" or "Pre-Release". These are provided "AS IS" and may contain bugs. The Company makes no warranties regarding Beta features.

6.1. The Company reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. The Company shall not be liable to Customer or any third party for any modification, price change, suspension, or discontinuance of the Service.

7.1. Platform Ownership: The Company owns all rights, title, and interest in the Service, including its code, design, and infrastructure.

7.2. Customer Content: Customer retains ownership of all data, text, and logic configurations ("Customer Data") uploaded to the Service. Customer grants Company a license to host and process this data solely to provide the Service.

8.1. The Service integrates with third-party platforms (e.g., Telegram, OpenAI, Google). The Company is not responsible for the availability, rules, or actions of these third parties.

8.2. If a third-party platform bans a Customer's Bot due to policy violations, the Company is not liable and no refund will be issued.

9.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". COMPANY MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

9.2. IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE.

9.3. COMPANY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY CUSTOMER TO COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10.1. These Terms shall be governed by and construed in accordance with the laws of the Russian Federation. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Arbitration Court of the Smolensk Region.
